Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by PT. Nicecoder Solusi Digital ("FrezzApp", "we", "us", or "our"). By using our services, you agree to these Terms.

1. Services

FrezzApp provides IT support services including but not limited to:

  • Application development and maintenance
  • Server and infrastructure management
  • Security and backup services
  • Monitoring and technical support

The specific services provided will be outlined in your service agreement or selected plan.

2. Service Plans and Payment

Subscription Plans

  • Plans are billed monthly in advance
  • Each plan includes a specified number of support hours
  • Unused hours do not roll over to the next month
  • Additional hours are billed at the rate specified in your plan

Payment Terms

  • Payment is due upon receipt of invoice
  • We accept bank transfer and major payment methods
  • Late payments may result in service suspension

3. Money-Back Guarantee

We offer a 14-day money-back guarantee for new customers. If you are not satisfied with our services within the first 14 days, you may request a full refund. This guarantee applies only to the first month of service.

4. Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months (except under the money-back guarantee)
  • We will provide reasonable assistance in transitioning away from our services

5. Client Responsibilities

You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Grant necessary access to systems for service delivery
  • Respond to communications in a timely manner
  • Comply with applicable laws and regulations

6. Acceptable Use

You may not use our services for:

  • Any illegal or unauthorized purpose
  • Distributing malware or harmful code
  • Spamming or phishing activities
  • Infringing on intellectual property rights
  • Any activity that disrupts our services or other clients

7. Intellectual Property

  • You retain ownership of your existing code and content
  • Work created specifically for you becomes your property upon full payment
  • We retain rights to general tools, frameworks, and methodologies
  • Open source components remain under their respective licenses

8. Confidentiality

We will maintain the confidentiality of your proprietary information and will not disclose it to third parties except as required to deliver services or as required by law.

9. Service Level

  • We aim to respond to support requests within 24 hours
  • Critical issues are prioritized and addressed as soon as possible
  • Scheduled maintenance will be communicated in advance
  • We do not guarantee 100% uptime but strive for high availability

10. Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is limited to the fees paid for services in the preceding 3 months
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for data loss; you are responsible for maintaining backups
  • We are not liable for third-party service outages beyond our control

11. Indemnification

You agree to indemnify and hold harmless FrezzApp from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

12. Modifications

We may modify these Terms at any time. We will provide notice of significant changes via email or on our website. Continued use of services after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved in the courts of Surabaya, East Java.
